»Public Offices Caught between Legal Requirements and Political Needs. On the Applicability of Art. 32 (2) GG to Political Civil Servants, Local Election Officials and Judges of the Federal Courts«: Capturing the political, policy-framing sphere in distinction to the other two constitutional powers is not always easy. There are public offices in the executive and even the judiciary branch which cross the borders by not exclusively being selected on the basis of merit, skills and experience but also because of political trust. A political recruitment by democratic elections must prove itself against a recruitment by codified legal standards based on the rule of law.
