The book is concerned with the price factor in the primary market of art and in particular with contractual arrangements for obtaining control over the price development of artworks. The focus of the analysis are the contractual rights of art dealers allowing to repurchase the sold artwork from the buyer for the case the buyer decides to resell it to a third party. The book analyses the legal typology of such agreements (options such as the right of first refusal and other pre-emptive rights) and the conditions of their lawfulness under German law. In additon to the question of unconsionability and the compliance with the German law on standard terms, the book examines the antitrust issues related to such pre-emptive rights after defining the relevant market determined for that purpose.
