Does the German constitutional ban on strikes for civil servants comply with the European Convention on Human Rights? According to the author this question requires a differentiated response, not only considering the right to strike but also the right to collective bargaining, which has likewisely been derived by the European Court of Human Rights. The research is focused on teachers as one special group among the civil servants, which does due to its function neither belong to the members of the armed forces, of the police nor of the administration of the State within the meaning of the Convention. Therefore interferences in the teachers freedom of association are more difficult to justify.
